Florida Reaffirms Ban on Motorcycle Lane Filtering After 2026 Bills Fail

Motorcycle lane filtering and lane splitting remain prohibited across Florida under Florida Statute 316.209, following the failure of legislative proposals during the 2026 session.
State traffic authorities and industry advisories, including a legal notice from Broward Motorsports Miami, have reiterated that riding between lanes of traffic or between adjacent rows of vehicles is an active, ticketable moving violation.
Advocacy groups and lawmakers introduced measures during the 2026 legislative session seeking to permit low-speed filtering through stationary vehicles stopped at red lights. Those proposals failed to pass into law, leaving Florida's longstanding statutory restrictions unchanged.
State authorities highlighted the issue for riders traveling to Florida for late-autumn rallies and winter touring. Motorcyclists visiting from out of state often assume that recent statutory allowances passed in Western states, including Colorado and Minnesota, apply across the country. Law enforcement agencies emphasize that filtering through stopped or slow-moving congestion in areas like Daytona or South Florida will result in traffic stops and moving-violation citations.
While filtering between lanes is prohibited, Florida law continues to allow lane sharing. Under Statute 316.209, two motorcyclists are legally permitted to ride side by side within a single lane by mutual consent.
